The Thunder Bay District Health Unit (TBDHU) has resorted to legal action against the owner of a seniors’ apartment complex for allegedly ignoring numerous health code violations. The health unit, represented by public health inspector Abby Mackie, issued compliance orders to SMS Property Trust Inc. following complaints regarding issues such as high temperatures, overflowing garbage, and bedbug infestations at Vickers Manor.
Mackie emphasized that issuing orders is a final measure, with the health unit typically preferring to engage in education and cooperation with property owners to rectify health hazards. However, in this case, the lack of response from the property owner necessitated legal intervention.
Vickers Manor, previously known as McKellar Place, provides independent and assisted living units for seniors. Situated at 325 Archibald St. S., the property is currently listed for sale at a significantly reduced price from its initial listing earlier this year.
Aside from health code violations, the owner is also facing numerous fire code infractions and financial difficulties that almost led to utility disconnections. SMS Property Trust Inc., led by Ongrasothy Masillamany, is confronting 36 offenses under the Health Protection and Promotion Act related to excessive heat within the building.
Masillamany is summoned to appear in court to address the compliance orders issued by TBDHU. A ruling and potential fine will be determined if the owner is found guilty.
Efforts to reach out to the management of Vickers Manor were unsuccessful, with Mackie noting the rarity of resorting to legal action due to unresponsive ownership. The hope is for new ownership to prioritize the safety and well-being of the tenants.
Meanwhile, Thunder Bay—Superior North NDP MPP Lise Vaugeois has called on the province to investigate the situation at Vickers Manor and ensure that residents are not displaced without appropriate housing solutions. The city authorities and community partners are actively monitoring the issue and working to provide necessary support to the tenants.
Amid the challenges faced by residents, individuals like Sharon Zoschke remain optimistic and committed to their community at Vickers Manor, hoping for a positive resolution without having to leave. Zoschke emphasized the importance of keeping tenants informed and maintaining respect for their dignity during these trying times.
