Investigations are underway into eight companies due to concerns about their online pricing practices, with an additional 100 businesses expected to receive warnings. The companies under scrutiny include StubHub, Viagogo, AA Driving School, BSM Driving School, Gold’s Gym, Wayfair, Appliances Direct, and Marks Electrical.
The Competition and Markets Authority (CMA) is focusing its investigations on how fees are displayed online, potential misleading time-limited offers, and the automatic inclusion of optional charges for customers. Specific areas of inquiry include additional charges on ticket-selling websites like StubHub and Viagogo, transparency of fees on AA Driving School and BSM Driving School websites, Gold’s Gym’s presentation of a one-off joining fee for annual membership, time-limited sales on Wayfair, default opt-ins on Marks Electrical, and the use of time-limited sales and default opt-ins on Appliances Direct.
The CMA stressed that these investigations are based on suspicions of consumer law violations, with no final decisions made yet. These cases mark the first instances of the CMA utilizing its new consumer protection powers. Alongside the ongoing investigations, the CMA is contacting 100 other businesses to address concerns regarding their use of additional fees and sales tactics.
Sarah Cardell, the CEO of the CMA, emphasized the importance of ensuring consumers can shop online confidently, knowing that prices are transparent and sales are genuine. She reiterated the CMA’s commitment to protecting consumers from misleading practices and illegal pressure selling. Businesses found in breach of consumer law will face consequences to safeguard consumer interests and promote fair dealings.
Representatives from AA Driving School and Viagogo expressed willingness to cooperate with the CMA’s investigations. The Mirror has reached out to Gold’s Gym, Wayfair, Marks Electrical, and Appliances Direct for comments. It is noted that BSM Driving School is under the ownership of the AA, while Viagogo and StubHub share a parent company.
